Civil Code 4041 Annual Update & Membership List

Civil Code Section 4041 requires all members to annually provide the associations with written notice 1) the member’s specified method of receiving notices from the association by mail or by email, or both; 2) an alternative or secondary method of receiving notices from the association by mail, by email, or both; 3) a valid email address, as well as the name, address and email of the owner’s legal representative, or other person who can be contacted in the event of the member’s extended absence from the separate interest.

Please log on to the Action Property Management Resident Portal and update the “Request for Annual Notice of Address, Representative and Rental Status”. This needs to be done annually by the member.

Membership List- The Common Interest Development Act requires the association upon written demand of a member to produce to any other member a membership list, including the name, property address, mailing address, and email address of all members.

  • The Common Interest Development Act requires the association upon written demand of a member to produce to any other member a voter list, including the name, voting power, either the physical address of the voter’s separate interest, the parcel number, or both, and mailing address (if it differs from the physical address) of all members.
  • Civil Code section 5220 allows members who do not wish to have their contact information shared with other members to “opt out” of sharing that information if the association provides the information from the requesting member to the opting-out member by an alternative method rather than giving the member’s contact information to the requesting member.
  • The following member(s) hereby direct the association to (a) withhold their contact information concerning said member(s), and (b) instead to transmit communications which another member desires to send to all members in an alternative fashion, either by first-class mail or as otherwise directed by the members below.

Association Property Tree Trimming and Removal/Replacement Policy and Form

Pursuant to Civil Code §4360, the Board of Directors will be considering re-adopting the proposed Association Property Tree Trimming and Removal/Replacement Policy and Form at their meeting scheduled for Thursday, April 21, 2022. The purpose and effect of this policy and form is to provide a procedure for members to follow if said member wants an association property tree altered beyond what is required or necessary during normal maintenance. If you wish to make any written comments on the “Association Property Tree Trimming and Removal/Replacement Policy and Form” please indicate your comments in the space designated on the notice sent to you and return it to Action Property Management so it can be delivered to the Board prior to the Board Meeting.  Alternatively, if you can attend the Board Meeting, your constructive comments will be considered by the Board of Directors prior to it making a decision on the proposed policy.  Any and all comments made at the Board Meeting will be subject to the standing rules of the Board related to member comments at Board meetings.

Mental health and substance abuse support through resources and local townhall meeting

To help residents cope with pandemic-related anxiety, the City of Mission Viejo is reminding residents of mental health and drug abuse prevention referral numbers – and is promoting a local Community Townhall on Addiction and Mental Health. 

The following numbers can provide important resources to anyone in need:

On Sunday, January 30, Red Songbird Foundation and Overtaken Lives are hosting an informal event from 4:30-7 pm at the Laguna Hills Community Center, 25555 Alicia Parkway. 

The townhall features drug abuse prevention advocate Jodi Barber who lost her teenage son to an opioid overdose and created the education videos “Overtaken” and “Overtaken II.”   

Personal testimonies and guidance on recovery and wellness will also be shared by others like Jason Wahler known for the reality TV series “The Hills.” Wahler’s struggle with alcohol dependency, rehab and mental health is inspirational and motivational. 

Resource tables and opportunities to discuss personal challenges with people who relate round out the event. The townhall is geared to people 18 and older. Register today at https://www.redsongbird.org/townhall

Your Association’s Annual Meeting of the Members was held on January 6, 2022. Two seats were up for election on the Board. The Election of Directors was successfully completed. Two (2) Director were elected to serve a two (2) year term.
